Indigenous people in Bintuni Bay oppose land deal with company Genting Oil Kasuri Pte

A National Strategic Project (PSN) in Bintuni Bay (Teluk Bintuni Regency), Papua Barat Province, has sparked concerns about the potential violation of indigenous land rights. The project, handled by Genting Oil Kasuri Pte. Ltd, is facing criticism for lack of transparency and adherence to the principle of Free, Prior, and Informed Consent (FPIC).

Environmental activist, Mr Sulfianto Alias, raised the alarm after reviewing a draft agreement between Genting Oil and the Sumuri indigenous people holding the customary land rights in the project area. The draft included a clause regarding the release of customary land, raising concerns about the long-term implications for the community. Mr Sulfianto accused the Teluk Bintuni district government of failing to protect the Sumuri people’s rights. He emphasized the need for the government to take action after granting official recognition to the indigenous community (see photo, on top source: Suara Papua).

Mr Sulfianto stated that Genting Oil is obliged to inform the Sumuri community transparently about the land use plans and release processes before any land is released. He further warned that the inclusion of a land release clause in the agreement might violate Law No. 32/2009 concerning the implementation of FPIC. He urged the local government to review the law and ensure compliance with legal provisions to prevent potential lawsuits.

The controversy extends beyond the land release clause. Reports indicate that a symbolic handover ceremony for compensation money to seven Sumuri clans was cancelled due to community concerns. While the clans accept the agreed-upon compensation, they object to the lack of clarity regarding land use contracts, the lease terms, and the duration of the lease period.
